Terms of Service for BRICK

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your", or "User") and Brick Fitness Pte. Ltd. ("Brick", "we", "our", or "us"). By accessing or using the Brick mobile application, website (https://brickfitness.app) or any related services (collectively, the "Services"), you acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy.

If you do not agree, do not use the Services.

1  Description of the Services

Brick provides triathlon-focused training software that enables you to log and analyse workouts, set goals, and synchronise activities with third-party platforms such as Strava.

2  Licence to use Brick

We grant you a personal, revocable, non-exclusive, non-transferable licence to download and use the Brick mobile application and website for your own training purposes, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of our software or included content unless expressly permitted by us in writing.

3  Account registration and accuracy

You must provide accurate account information and keep it up to date. You are responsible for safeguarding your login credentials and all activity on your account.

4  Subscriptions, fees and refunds

Subscriptions. Certain features require a paid subscription. Prices, billing intervals and trial periods are displayed in-app prior to purchase.

Payments. Payments are processed by Stripe or the App Store / Google Play, as applicable. All fees are charged in the currency shown at checkout.

Trials. If you sign up for a free trial, you will not be charged until the trial ends. You can cancel at any time before the trial expires to avoid charges.

Refunds. We honour platform-specific refund policies (Apple App Store: 14-day; Google Play: 48-hour) plus our own 7-day money-back guarantee for direct Stripe purchases.

5  Strava connection and data usage

When you tap Connect with Strava, you authorise us to access your Strava activity data for the purposes described in our Privacy Policy.

We will display your Strava data only to you inside the Brick application and will not share, sell or use it to train AI models unrelated to your own account.

You may revoke access at any time in-app (Settings → Connections) or by using Strava's de-authorisation endpoint. Revocation deletes imported Strava data from our servers within 24 hours.

Trademark notice. Strava and the Strava logo are registered trademarks of Strava Inc. Brick is independent and not endorsed by Strava. Strava bears no responsibility for the functionality or content of Brick.

6  Acceptable use

You agree not to:

Use the Services in any unlawful manner or for any unlawful purpose;

Upload malicious code, scrape, reverse-engineer, or interfere with our systems;

Violate intellectual-property rights or privacy rights of others;

Attempt to gain unauthorised access to other users' accounts or data.

7  Termination

We may suspend or terminate your account if you breach these Terms or if required by law. You may delete your account at any time in the app. Upon termination, your licence to use the Services ends immediately and we will delete your personal data in accordance with our Privacy Policy.

8  Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose and non-infringement. Your use of the Services is at your sole risk.

9  Limitation of liability

To the maximum extent permitted by law, Brick and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your use or inability to use the Services;

Any unauthorised access to or use of our servers and/or any personal data stored therein;

Any interruption or cessation of transmission to or from the Services.

In no event will Brick's aggregate liability exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) SGD 100.

10  Indemnity

You agree to indemnify and hold harmless Brick and its officers, directors, employees and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Services or violation of these Terms.

11  Modifications to the Services and these Terms

We may update the Services or these Terms at any time. Material changes will be notified via email or prominent in-app notice at least 7 days before they take effect. Continued use of the Services after changes become effective constitutes acceptance of the new Terms.

12  Governing law and dispute resolution

These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Singapore courts.
